Adjudication REVIEW

Today's Adjudication REVIEW meeting concerns the process in which the community resolves complaints, known as adjudication. Currently, complaints are taken in writing at the front office during business hours. The complaint filed with the office is stamped with the current date, and staff are required to give you a stamped dated copy of your complaint as well. This process has not always been followed. There are three items of interest:

  • Pines Talk forum posts indicate that after filing complaints, the adjudication committee was not able to form properly, where the committee members did not show up to the meeting. (Who informs the committee members of their obligations? In some months there are ZERO complaints? There is a law written as to what is a properly formed committee.)
  •  And in other cases, stamped dated copies were not given to those who filed complaints.  (What is the process when stamped dated copies ARE NOT GIVEN aside from ignoring the complaint?)
 
  • The adjudication process did not address the complaints fully and ignored areas addressed in the written complaint. (The complaint should be read aloud AND IN ITS ENTIRETY during adjudication instead of being sequestered and concealed by the adjudication committee members and other witnesses present.)
The fourth item, not mentioned in any HOA Board Proceeding, Newsletter, or its free advertisements, is the filing of electronic complaints via email.  The OFFICIAL WEBSITE proclaims an email address for the property standards "person", but the HOA refuses email via Facebook or any other means in the way of filing an official complaint.  There is NO OFFICIAL communications policy with regards to the HOA receiving emailed complaints. The issue has NOT BEEN addressed since 2010, when the Nisqually Pines Facebook page revealed the double standards of the HOA, the incredible audacity of those serving with both Adjudication and Property Standards, and the blatant disregard  for our HOA CCR's and due process. In any case, the property standards person was removed, and Amber has taken over Property Standards complaints with the hopes that ALL PROPERTY STANDARDS ADJUDICATION issues held previous to Amber should come under a REVIEW .
